This agreement is between you and GaffSwipe Ltd ("we", "us"). It covers your licence to install and use the GaffSwipe mobile app (the "App"). Your use of the GaffSwipe service through the App is also covered by our Terms of Service and Privacy Policy. If anything here conflicts with the Terms of Service, the Terms of Service apply.
1. Licence
We give you a personal, non-exclusive, non-transferable, revocable licence to download, install and use the App on any iPhone or Android device that you own or control, for your own non-commercial use. Landlords and agents may also use it to manage their own listings.
On Apple devices, your use must also follow the Usage Rules in the Apple Media Services Terms and Conditions. On Android devices, it must also follow the Google Play Terms of Service.
2. What you can't do
Except where the law allows it, you must not:
- copy, modify, translate, decompile, disassemble or reverse-engineer the App;
- rent, lease, lend, sell, sublicense or distribute the App;
- remove any copyright, trade mark or other notices;
- use the App to build a competing product, or to scrape, harvest or bulk-download listings or user data;
- get around any security, rate limit or access control; or
- use the App in any way that breaks the law or our Terms of Service.
3. Ownership
We, or our licensors, own the App and all intellectual property rights in it, including the GaffSwipe name and logo. This agreement gives you a licence to use the App, not ownership of it. The App includes open-source components, which are licensed under their own terms. You can see these in the App under Settings → About → Open-source licences.
4. Updates
We may release updates to fix bugs, improve security or add features. Some updates may be required to keep using the App. If you don't install them, parts of the App may stop working.
5. Permissions
The App asks for permission to use your camera and photo library (to add photos) and to send notifications. We'll explain why each time it asks, and you can change these permissions in your device settings. The App doesn't use your device's location.
6. Ending the licence
This licence lasts until you or we end it. You can end it by deleting your account and uninstalling the App. We can end it if you seriously or repeatedly break this agreement or our Terms of Service. When it ends, you must stop using the App and delete it from your devices.
7. Warranty and liability
We provide the App with reasonable care and skill, and your statutory consumer rights are not affected. Beyond that, the App is provided "as is". We don't promise it will be uninterrupted or error-free, or that it will work on every device. Our liability to you is as set out in our Terms of Service.
8. If you downloaded the App from Apple's App Store
- This agreement is between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for dealing with any claims from you or any third party relating to the App or your use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and consumer protection, privacy or similar claims.
- If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the App, such as your mobile network's terms.
- Apple and its subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple has the right to enforce it against you as a third-party beneficiary.
9. Law
This agreement is governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
